Terms and Conditions for Rubbish Removal Stockwell

These Terms and Conditions set out the basis on which Rubbish Removal Stockwell provides waste collection and rubbish clearance services to domestic and commercial customers in our service areas. By placing a booking, confirming a quotation or allowing our team to commence work, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any person, business or organisation that requests or receives services from Rubbish Removal Stockwell.

Services means any rubbish removal, waste collection, clearance, loading, transportation, recycling or disposal work carried out by Rubbish Removal Stockwell.

Waste means any rubbish, junk, debris or other materials that the Customer asks Rubbish Removal Stockwell to collect and remove.

Booking means a confirmed request from the Customer for the Services, whether made by telephone, email, online form or other agreed method of communication.

Agreement means the contract between the Customer and Rubbish Removal Stockwell consisting of these Terms and Conditions and any written quotation or confirmation of booking issued by Rubbish Removal Stockwell.

2. Scope of Services

Rubbish Removal Stockwell provides waste collection and rubbish clearance services, including but not limited to household waste removal, garden waste collection, light construction debris clearance, office clearance and general junk removal. The exact scope of the Services for each job will be as described in the quotation or booking confirmation issued to the Customer.

We reserve the right to refuse to remove any item or type of waste that we reasonably believe to be prohibited, unsafe, unlawful to transport, or beyond the scope of our licence or capabilities. We will inform the Customer as soon as reasonably practicable if any such refusal applies.

3. Booking Process

Customers may request Services by contacting Rubbish Removal Stockwell by telephone, email or other published communication channels. Any initial discussion or indication of price is not binding until we confirm acceptance of the booking.

A Booking will be considered confirmed when we provide the Customer with a clear acceptance by telephone, email or booking confirmation message, which may include the date and time window for service, the estimated volume or weight of waste and the applicable price or pricing structure.

The Customer is responsible for ensuring that all information provided when making a Booking is accurate and complete, including the service address, access details, description of waste, parking restrictions and any relevant property considerations.

Rubbish Removal Stockwell may request photographs of the waste or further details in order to provide a more accurate estimate before confirming a Booking.

4. Quotations and Pricing

Any quotation provided by Rubbish Removal Stockwell is based on the information supplied by the Customer and is usually an estimate. The final price may vary depending on the actual volume, weight, type of waste, time required on site, access conditions, or any additional Services requested at the time of collection.

Where practicable, the team will assess the waste upon arrival and confirm the price before loading any material. If the Customer does not accept the revised price, the team may leave without completing the Service, and a call-out or attendance fee may be charged to cover costs incurred.

All prices are provided in pounds sterling and may be subject to value added tax at the prevailing rate, where applicable. Any such charges will be clearly communicated to the Customer.

5. Access and Parking

The Customer must ensure that safe and reasonable access is available at the agreed time of collection, including any necessary information about building entry, gates, security procedures or restricted areas.

The Customer is responsible for arranging and, where required, paying for any parking or permits necessary for our vehicles to perform the Services. If suitable parking cannot be found or legal parking is not available, we may not be able to complete the job, and a reasonable cancellation or waiting charge may apply.

Rubbish Removal Stockwell is not liable for any penalties, fines or charges arising from instructions given by the Customer that lead to our vehicles being parked in contravention of local regulations.

6. Customer Obligations

The Customer confirms that they either own the waste to be removed or have full authority from the owner to arrange for its collection and disposal. The Customer agrees to indemnify Rubbish Removal Stockwell against any claims made by the owner of the waste or any third party.

The Customer must ensure that waste is accessible and, where agreed, suitably bagged, boxed or prepared for collection. Any special handling requirements must be communicated in advance.

The Customer must not include within the waste any items that Rubbish Removal Stockwell has previously stated it cannot or will not accept, including but not limited to hazardous or prohibited materials.

7. Prohibited and Hazardous Waste

Rubbish Removal Stockwell does not normally collect hazardous, clinical or certain controlled wastes, including but not limited to asbestos, chemicals, solvents, oils, gas cylinders, medical waste, biological waste, explosives or any materials classified as hazardous under applicable legislation.

If such waste is discovered during the job and was not disclosed in advance, we reserve the right to refuse collection of those items, adjust the quotation, or withdraw from the job. The Customer may still be liable for call-out or attendance charges.

Where specific arrangements are made to collect special or regulated wastes, this will be subject to separate terms, pricing and compliance requirements, which will be confirmed in writing.

8. Payments and Charges

Unless otherwise agreed in writing, payment for the Services is due immediately upon completion of the job and before our team leaves the site. We may require payment in advance, particularly for larger jobs or commercial customers.

Rubbish Removal Stockwell accepts various payment methods, which may include cash, debit or credit card, or bank transfer, subject to availability and any conditions communicated at the time of booking.

For account customers or where credit terms have been agreed in writing, invoices are payable within the timeframe specified on the invoice. Late payment may result in interest and reasonable administrative charges being added, in accordance with applicable legislation.

If payment is not received in accordance with these terms, Rubbish Removal Stockwell reserves the right to suspend or refuse further Services and to take appropriate steps to recover any outstanding sums.

9. Cancellations and Amendments

The Customer may cancel or amend a Booking by giving Rubbish Removal Stockwell reasonable notice prior to the agreed arrival time.

Where the Customer cancels with sufficient notice, no cancellation fee will normally apply. However, we reserve the right to charge a reasonable fee where late cancellations result in wasted journeys, allocated vehicle time or staffing costs.

If the Customer cancels or significantly alters the job on arrival of our team, or if we are unable to proceed due to lack of access, parking, incorrect information or the presence of prohibited items, we may charge a call-out fee or partial fee to cover our costs.

Rubbish Removal Stockwell may cancel or reschedule a Booking if we are unable to attend due to circumstances beyond our control, including but not limited to vehicle breakdown, severe weather, road closures or staff illness. In such cases we will endeavour to notify the Customer as soon as reasonably practicable and offer an alternative appointment.

10. Performance of the Services

We will use reasonable care and skill in providing the Services and will make reasonable efforts to carry out collections at the agreed time or within the agreed time window. However, any times given for arrival or completion are estimates and are not guaranteed.

The Customer must notify us as soon as possible if they have any concerns about the way in which the Services are being performed, so that we can take appropriate steps to address the issue.

11. Damage to Property

Rubbish Removal Stockwell will take reasonable care to avoid damage to property while performing the Services. The Customer is responsible for moving any fragile items or possessions that may be at risk and for advising our staff of any particular risks, weaknesses or sensitivities at the property, such as loose paving, weak floors, delicate walls or fixtures.

We will not be liable for damage that arises from pre-existing defects, structural weaknesses or conditions that were not reasonably apparent, or from the movement or removal of items at the Customer's express request where we advised of a risk of damage.

Any claim for damage must be notified to us in writing as soon as reasonably practicable and in any event within seven days of the Services being performed, providing full details and, where possible, photographs.

12. Liability and Limitations

Nothing in these Terms and Conditions will limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law.

Subject to the above, Rubbish Removal Stockwell will not be liable for any indirect, consequential or purely economic loss, including loss of profit, business interruption, loss of opportunity or loss of data, arising out of or in connection with the provision of the Services.

Our total liability to the Customer in respect of any claim arising out of or in connection with the Agreement, whether in contract, tort, negligence or otherwise, will not exceed the total price paid or payable by the Customer for the specific job giving rise to the claim.

13. Compliance with Waste Regulations

Rubbish Removal Stockwell operates in accordance with relevant UK waste management legislation and environmental regulations. We will transport and dispose of waste using authorised facilities and methods, and will maintain any required licences, registrations or permits in connection with our activities.

The Customer acknowledges that once waste has been collected by Rubbish Removal Stockwell, it will be managed in compliance with applicable laws and may be reused, recycled, recovered or disposed of as appropriate. Ownership of the waste transfers to Rubbish Removal Stockwell at the point of collection, unless otherwise agreed in writing.

We may provide, on request and where relevant, appropriate documentation confirming lawful transfer or disposal of waste, subject to any administrative charges that may apply.

14. Photographs and Records

Rubbish Removal Stockwell may take photographs or keep written records of waste before and after collection for operational, health and safety, regulatory or evidential purposes. Such records may also be used to verify the nature and volume of waste collected and to support invoicing and quality control.

Any personal data obtained in connection with the Services will be handled in accordance with applicable data protection laws and our internal policies.

15. Force Majeure

Rubbish Removal Stockwell will not be liable for any delay in performing, or failure to perform, any of our obligations under the Agreement where such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include but are not limited to extreme weather, natural disasters, acts of government or public authority, strikes, civil unrest, road closures, vehicle breakdowns, or failures of utilities or telecommunications.

In such circumstances, we will use reasonable endeavours to resume performance of the Services as soon as reasonably practicable.

16. Variation of Terms

Rubbish Removal Stockwell reserves the right to update or amend these Terms and Conditions from time to time. Any revised terms will be effective from the date on which they are published or otherwise communicated to the Customer and will apply to all Bookings made after that date.

The terms in force at the time of confirming a Booking will apply to that particular Agreement, unless a change is required by law or regulatory authority, in which case it may apply retrospectively if necessary.

17. Assignment

The Customer may not assign, transfer or subcontract any of their rights or obligations under the Agreement without the prior written consent of Rubbish Removal Stockwell.

Rubbish Removal Stockwell may assign, transfer or subcontract part or all of its rights and obligations under the Agreement, provided that this does not materially reduce the level of service provided to the Customer.

18. Severability

If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision will be deemed deleted, and the remaining provisions will continue in full force and effect.

19. Entire Agreement

The Agreement constitutes the entire agreement between the Customer and Rubbish Removal Stockwell in relation to the Services. It supersedes any prior agreements, understandings or arrangements, whether written or oral, relating to the subject matter of the Agreement.

The Customer acknowledges that they have not relied on any statement, promise or representation made or given by or on behalf of Rubbish Removal Stockwell that is not set out in these Terms and Conditions or in the written quotation or booking confirmation.

20. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, formation or performance, are governed by and construed in accordance with the laws of England and Wales.

The Customer and Rubbish Removal Stockwell agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the Agreement or its subject matter.
